Appellate Court Dismisses Nnamdi Kanu’s Rights Suit Against DG DSS, AGF

The Court of Appeal in Abuja has dismissed the appeal filed by the convicted leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, against the Director General of the Department of State Services (DSS) and the Attorney-General of the Federation (AGF).

Kanu’s suit alleged a breach of his fundamental human rights, including the right to human dignity, quality healthcare, and religion, while he was detained in the DSS facility.

Delivering the judicial ruling, a three-member panel of the appellate court found that the appeal lacked merit and had become “academic.” This decision follows Kanu’s prior terrorism conviction by a Federal High Court on November 20, which resulted in a sentence of life imprisonment.

Justice Boloukuromo Ugo, who delivered the lead judgment, stated that the substance of the case was no longer feasible since Kanu was convicted and subsequently remanded in prison custody (Sokoto prison). The court noted that it could no longer grant his request to be moved to Kuje prison, as he had sought to be relocated from DSS detention.

The judgment affirmed an earlier ruling by a Federal High Court that had dismissed Kanu’s rights enforcement suit, confirming that the issues raised by the IPOB leader regarding his treatment in DSS custody are now superseded by his conviction and current remand status.
